3. Submit Your DMCA Complaint

4. Response to DMCA Complaints

Upon receiving a valid DMCA notice:

  • We will remove or disable access to the infringing material.
  • We will notify the user responsible for the content about the complaint.
  • If applicable, we may terminate repeat offenders’ access to our services.

5. Counter-Notification Process

If you believe that the material removed under a DMCA notice was done so in error or that you have the legal right to use the material, you may file a counter-notification. A valid counter-notification must include:

  1. Your Contact Information:

    • Full name
    • Mailing address
    • Email address
    • Phone number
  2. Identification of the Removed Material:

    • A description of the content that was removed and its location before removal.
  3. Statement of Good Faith:

    • A declaration under penalty of perjury that you have a good faith belief that the material was removed due to a mistake or misidentification.
  4. Consent to Jurisdiction:

    • A statement consenting to the jurisdiction of the federal court in your district or, if outside the United States, the jurisdiction of the courts in the location where the service provider is located.
  5. Your Electronic or Physical Signature:

    • A signature (typed or physical) of the individual filing the counter-notification.

6. Repeat Infringers

In accordance with the DMCA, KAPtv maintains a policy to terminate the accounts of repeat infringers when appropriate.
